I. Parties to the agreement 1. Training center: AB Academy s.r.o. Identification number: 171 84 304 VAT number: CZ17184304, Head office: Rybna 716/24, Stare Mesto, 110 00 Prague 1 2. Customer (the person who registered for the course, from the moment the course began - a participant in the course. II. Contract object 1. The subject of activity is the teaching of requalification, educational and additional courses, as well as conducting professional qualification exams in selected specialties. 2. The Training Center undertakes to provide a retraining course, or another course as proposed by the Training Center in accordance with the Customer’s confirmed application upon reaching the minimum number of people for the course and on the basis of payment of the cost of the course and providing the Customer with the opportunity to participate. 3. The customer is obliged to read the curriculum of the course or exams, description of the course, exams and other information regarding the curriculum, teaching of the course, indicated for each specific course on the website https://www.abacademy.cz 4. By filling out an application for the course (electronically on the website or in person directly at the training center), the client agrees to the conditions set out in paragraph 2 of this agreement, and the client does not have the right to demand changes to the above in accordance with his needs and requirements. 5. The customer undertakes to pay the training center the cost of participation in the course (“course fee”) according to the current price list. 6. The number of course participants is at least 2 people. The course is not individual. III. Entry into force of the Treaty - You can register for participation in the course electronically, on the website (ONLINE TRAINING AGREEMENT): ONLINE TRAINING AGREEMENT or by completing the contract directly in the office at the address: Cymburkova 376/5, Prague 3, Mikolas Alše 2099/8, Most, or by phone 777042802.
- After placing an order on the training center’s website, registration of the application is confirmed by an email response from the training center’s automatic system. The order confirmation contains information for payment for the course, indicating the details for paying the cost of the course.
- The agreement between the training center and the client (hereinafter referred to as the “agreement”) comes into force, unless otherwise specified in the agreement, at the moment of depositing funds into the account of the training center on the terms set out in the “Contractual conditions for organizing courses”.
- By paying and filling out an application for the course, the customer confirms that he agrees with the Contractual terms of the organization of the courses and he knows the curriculum of the course or exams, description of the course, exams and other information relating to the curriculum indicated for each specific course on the website: https: //www.abacademy.cz
IV. Course cost - The course price is always indicated for individual courses for which the customer registers by submitting a completed application.
- The customer undertakes to pay the training center the cost of the course in the amount specified in the training center’s offer published on the website ONLINE TRAINING AGREEMENT | (abacademy.cz), valid at the time the customer places the order.
- If the customer has an agreement with the employment agency, the cost of the course will be paid by the employment agency.
- In case of non-payment of the course fee, the contract does not come into force.
- The customer undertakes to pay the cost of the course by bank transfer to the account of the training center, or via PayPal after placing an order for ONLINE TRAINING AGREEMENT | (abacademy.cz), in accordance with the conditions of the training center - instructions sent in the order confirmation.
- If the course fee is not paid to the training center properly and on time, the customer has not rights under the contract. In this case, the training center will refuse the client to participate in the course.
- Having completed and sent the application, the customer is included in the register of interested parties; a place on the course is reserved only after payment of the course fee.
- Payment for the course is made no later than 5 days after completing the application. If the application is completed less than 5 days before the start of the course, payment must be made before the start of the course.
V.Rights and obligations of the contracting partie - Students are required to comply with safety and health regulations in accordance with current legal regulations and pay special attention to the safety and health of other students.
- Students are required to follow the instructions of the training center and its teacher throughout the course.
- The minimum age of students is 18 years old.
- The student must arrive at the course location on the agreed day.
- Participation in the course under drugs or alcohol is prohibited.
- The teacher has the right to exclude from participation in the course students who violate health and safety rules or instructions from the lecturer, as well as persons who can reasonably be expected to be under alcohol or drugs. In this case, the student is not entitled to a refund of the course.
- The teacher has the right to exclude from participation in the course students who, by their inappropriate behaviour, disrupt the course of the lesson, do not follow the instructions of the lecturer and do not cooperate during the lesson. Such will be asked to student to make corrections; in case of repeated disruptions in teaching or non-compliance with the lecturer’s requirements, for further violations he will be warned in writing and subsequently expelled from the course with a fine of 5 000 Kč, without the right to return money for the course, payment or part thereof.
- Students must respect the role of educators. It is forbidden to shout, offend or humiliate the teachers.
- Students can only attend the course in the field specified in the training contract at the school.
- The practical part in another direction, not specified in the training contract, cannot be carried out.
- It is forbidden to eat or drink during the lessons of course.
- Students must leave the school at the end of lessons of course; it is not allowed to remain at school after closing time.
- Students cannot receive financial compensation from models during the practical part.
- Teachers do not accept gifts (souvenirs, bonus cards, chocolates, flowers, etc.), not during the course, not at the end of it.
- The student is responsible for assessing whether he is medically and physically ready to take the course. If participation in the course is subject to the presentation of a medical card, the student must obtain it from his local doctor before the start of the course.
- The student must inform the teacher before starting the course about any health restrictions (allergies, etc.) that he suffers from, and which must be taken into account during the course.
- The training center is not responsible for objects or things lost by students during the lessons of course. The training center will nor refund the students.
- Medical dress-code by students is prohibited during the lessons of the course.
- The training center will give safety and health regulations in accordance with current legal regulations to students. Every student must be responsible for ownself and must be careful to not damage others.
- Lessons are not held on public holidays, Christmas holidays and Easter Monday, as well as on other days specified at the start of the course.
- Teaching retraining courses are aimed to prepare for professional qualification exams. Accredited courses are by the Ministry of Education.
- The professional qualification examination is determined by the conditions of the Ministry of Health.
- The training center undertakes to conduct the course according to its description on the website https://www.abacademy.cz provide to students all equipment and tools necessary to attend the course just at school. It is forbidden to bring tools at own home.
- After the course, will be the final exam. After successfully passing the exam, students will receive the Diploma and they must leave the school definitely.
At the end of Masterclass/Workshop, students will receive the Certificate and they must leave the school definitely. VI. Cancellation of the course by the training center and cancellation of participation in the course by the customer - The training center has the right to cancel a lesson of the course at any time, especially in the following cases: - at least two people on the day of the course; - the teacher will not be able to teach the course due to disability or other serious reason - another serious obstacle will interfere with the course (for example, an accident at the institution, force majeure).
- If the training center changes the date of the course or cancels the course, the training center will offer to the student a new date. The course schedule will be sent by email.
- The student has the right to withdraw from the contract/application registration for a course, concluded remotely or at an institution, within 10 days from the date of conclusion of the training contract.
- If the student is unable to attend the course due to health reasons and provides a copy of a doctor's certificate, he can choose an alternative date for the ordered course or another course, no later than 6 months from the date of application.
- Cancellation of participation in a course in accordance with the contractual terms of the course organization. The cancellation fee is 5 000 kč, including any compensation for damages.
- The student can withdraw from the contract only if this is provided for by law or the Conditions of the contract for the organization of courses.
VII. Complaints - If a student has any questions or comments regarding the course delivery by the training center, he must inform the training center personally and promptly, “without unnecessary delay” and request any clarifications or corrections. The training center will not take into account any complaints without prior procedure, especially in the run-up to the end of the course.
- The basis for a complaint cannot be the teaching materials used, a change of lecturer in the course or the distribution of training time. The reason for the complaint cannot also be facts that were known to the student before the establishment of the contract, for example, the place of study, etc.
VIII. Protection of personal information - By filling out and applying for the chosen course, the student provides in accordance with Law No. 101/2000 Coll. on the protection of personal data, as amended, the operator consents to processing. data specified in the application for the purpose of inclusion in the client database and sending information about the training center’s offers for the period of activity of the training center.
- Consent is voluntary. The provided data will not be processed by third parties, with the exception of the Ministry of Education and the Ministry of Health, where the academic center must send data on course graduates. However, without submitting this information, valid exam certificates cannot be issued. Consent is provided for the period until its withdrawal. Consent can be revoked at any time by email info@abacademy.cz or by phone 777042802.
IX Final Provisions - All text, illustrations, graphics and photographs contained in the materials, as well as on websites and other sites presented in the courses, are protected by copyright and may not be copied or further used without the written consent of the owner.
- It is prohibited to take photos, to make videos, to record audios during the lessons of courses.
- The student is obliged to immediately notify the training center of any changes to their identification, billing and contact information that may affect the provision of the service.
- The rights and obligations of the contracting parties not expressly regulated in these terms and conditions are governed by generally applicable legal rules, as amended.
- The training center has the right, at its discretion, to supplement and update these Terms and Conditions for organizing courses. The training center informs the other party to the contract about such changes no later than 10 days before the changes come into force. The other party to the contract may express its disagreement with changes to the terms of the contract within 10 days from the date of notification of these changes, otherwise the amended or updated terms of the contract for the organization of courses will apply to the contractual relations between the parties to the contract. In case of disagreement with a change in the contractual terms of the course organization, the other party to the contract has the right to terminate the contract within 10 days from the date of notification of the changes.
- In accordance with § 273 of the Commercial Code, these conditions are considered the General Conditions of AB Academy s.r.o. with legal address: Rybna 716/24, Stare Mesto, 110 00 Prague 1, valid from July 1, 2023. Any changes to these terms and conditions can only be made in writing.
